Remake of the Transport Operations (Marine Pollution) Regulation
Some parts of the Regulation will not see any changes as they are considered effective and provide the best possible outcomes for government, the maritime industry, boating community and the marine environment.
There are parts of the Regulation that have been amended to reflect the current version of International Convention for the Prevention of Pollution from Ships (MARPOL 73/78), which Australia is a signatory to. Because MARPOL is an international convention these amendments cannot be altered.
Maritime Safety Queensland has also proposed further amendments to the regulation to clarify some areas of ambiguity and also strengthen the Regulation to improve marine environment protection outcomes.
Some of the proposed amendments will impose some costs on ship owners to comply with the sewage provisions; however Maritime Safety Queensland has constructed the legislation in a way that allows ship owners to make a choice of alternatives that best meet their circumstances.
A RIS has been prepared in accordance with the Statutory Instruments Act 1992. Consultation about the review will be undertaken primarily in writing through responses to the RIS.
All members of the community are invited to comment on the information presented in the RIS.
The closing date for written submissions is Friday, 23 February 2007.
